Terms of Service

These Terms of Service ("Terms") govern your use of ticketingplug.com, the Bar Plug cashless payment system, and related apps (together, the "Service"), operated by DLW ("we," "us," "our"). By creating an account, purchasing a ticket, or using Bar Plug, you agree to these Terms.

1. The Service

Ticketingplug is a ticketing marketplace that lets event organizers ("Organizers") list and sell tickets to events, and lets fans discover events and buy tickets. Bar Plug is a cashless payment feature that lets you load credits to spend at participating events. We act as the ticket seller/distributor and payment facilitator for the events on our platform; Organizers are responsible for the events themselves - including event content, safety, and delivering the experience described in the listing.

2. Accounts

You need an account to buy tickets. You're responsible for keeping your login secure and for all activity under your account. We use passwordless (magic link) sign-in; treat access to your email as equivalent to a password.

3. Tickets, pricing, and refunds

All-in pricing.The price you see at checkout is the total price, inclusive of any service fee. There are no additional mandatory fees added at checkout beyond what's displayed.

Advance ticket funds.Where required by law, payments for advance tickets to events held in New York are deposited in escrow and released upon the performance of the event, as required by New York Arts & Cultural Affairs Law § 23.08.

Your refund rights. If an event for which you've purchased an advance ticket is cancelled or rescheduled, you are entitled to a refund of your ticket price, exceptwhere: (a) there is no material change in the time or location of the event; (b) the event is rescheduled due to an act of God, war, riot, or similar catastrophe beyond the Organizer's control, and you're given the right to use your ticket for the rescheduled date or exchange it for a comparable event; or (c) your ticket states that, if the event is cancelled or rescheduled, you'll instead be given the right - within 12 months of the original date - to attend the rescheduled performance or exchange your ticket for a comparable one.

Outside of a cancellation/reschedule, all ticket sales are final unless the Organizer's listing states otherwise. Resale of tickets may be subject to additional restrictions under applicable state law.

4. Bar Plug cashless credits

Bar Plug credits are a prepaid balance you can load and spend at participating events for food, drinks, and merchandise. Credits are non-transferable to other users.

5. How we use and share your information

Our Privacy Policy describes this in full and is incorporated into these Terms. In short: your order and event-attendance information is shared with the Organizer of the event you're attending, including aggregated, de-identified analytics about their audience. We only share your individual contact information with an Organizer for their own marketing useif you've separately opted in to that at checkout - that opt-in is optional and can be withdrawn at any time.

6. Prohibited conduct

You agree not to: use the Service for any unlawful purpose; resell tickets in violation of applicable state ticket-resale law; use bots or automated means to purchase tickets in violation of the BOTS Act or similar state law; provide false information; or interfere with the security or operation of the Service.

7. Organizers

Event organizers using ticketingplug to sell tickets may be subject to additional terms governing settlement timing, revenue share, and data-handling obligations for any fan information we share with them.

8. Intellectual property

The Service, including its design, software, and content (excluding Organizer-provided event content), is owned by DLW and protected by intellectual property law. You may not copy, modify, or reverse-engineer the Service.

9. Disclaimers

The Service is provided "as is." We don't guarantee that events will occur as scheduled, that the Service will be uninterrupted or error-free, or that any Organizer will perform as advertised - except as expressly required by Section 3's refund rights.

10. Limitation of liability

To the fullest extent permitted by law, DLW will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. [This section is a placeholder pending attorney review and should be revisited before this is treated as final.]

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

12. Changes to these Terms

We may update these Terms from time to time; we'll post the updated version here with a new "Last updated" date. Continued use of the Service after changes take effect means you accept the updated Terms.
